The petroleum refining industry is undoubtedly the most heavily regulated manufacturing industry in the United States. Petroleum refining margins are down. Some refiners are operating at losses in the millions of dollars range on a daily basis.
Environmental, health, and safety (EH&S) laws are become increasingly more stringent, leading to increased capital and operating expenditures in order to demonstrate and maintain compliance (dare we mention Cap and Trade under the Federal Greenhouse Gases Mandatory Reporting Rule). The alternative of course are financial penalties stemming from non-compliance.
In summary: petroleum refiners are losing money, but operating costs continue to increase.
Let’s focus on one element of EH&S compliance, air quality. Let’s consider the cost of administering an air quality program at a petroleum refinery. There are capital and operating costs associated with labor for permitting, program management, routine inspections, equipment repairs, compliance audits, as well as daily; weekly; quarterly; and semiannual recordkeeping and reporting requirements. Maintaining compliance in light of this exhaustive set of requirements can be both onerous and susceptible to risk.
We recognize the need to reduce operating costs without compromising the reliability of EH&S compliance systems.
